These General Terms and Conditions govern the terms, manner and conditions for purchases and sales through the e-shop of MIRAGE 96 - NB Ltd. These General Terms and Conditions constitute a contract of purchase and sale between Rilus and the Customer.
По смисъла на настоящите Общи условия изброените понятия са използвани със следното значение:
a/ Rilus is a trading company with the name Mirage 96 - NB Ltd, UIC: 115036964 with registered office and management address in Plovdiv, ul. Lyuben Karavelov 10B, providing goods and services online through the E-store: https://rilus.bg/, тел.: 032 900 777 (цената на разговора е според тарифния план на клиента).
б/ Под „Стока” се разбира, всеки от предлаганите артикули в Е – магазина, който е описан с основните си характеристики, изображение и продажна цена.
в/ Под „Клиент” се разбира всяко лице, което е закупило или е направило заявка за покупка на стока от електронния магазин.
г/ Електронен магазин е виртуален магазин с електронен адрес https://rilus.bg/
д/ Под „ЗЗП” се разбира Закон за защита на потребителите.
е/ Под „ЗПК” се разбира Закон за потребителския кредит.
- ОБЩИ ПОЛОЖЕНИЯ
1 MIRAGE 96 - NB Ltd. provides the Customer with the opportunity to purchase the goods offered through the E-store by placing an order and paying the respective sales price, subject to the Customer's compliance with these Terms and Conditions.
1.2 The contract of sale between MIRAGE 96 - NB Ltd. and the Customer shall be deemed to be concluded at the moment of confirmation of the order made by the Customer, and in the case of an order for unavailable goods, the contract shall be deemed to be concluded at the moment of payment of the advance amount. - ПОРЪЧКА
Процедурата по поръчката от сайта е доброволна и безплатна. Сайтът може да бъде разглеждан от ползвателите свободно без да е необходима регистрация. За да се направи поръчка е необходимо да попълните регистрационен формуляр.
Полетата, които задължително следва да бъдат попълнени са отбелязани със звездичка.
Upon successful completion of the order, an employee of MIRAGE 96 - NB Ltd. will contact the Customer via the contact number provided, confirming that the goods are available, and then send an email that the order has been confirmed.
Чрез електронна поръчка от онлайн магазина могат да бъдат закупувани единствено и само тези стоки, които системата позволява да бъдат добавяни в пазарската кошница на ползвателя.
3. ЦЕНИ
All prices quoted on the site are in Bulgarian levs including taxes and fees and delivery charges, which are calculated separately, and are valid only at the time of publication. Mirage 96 - NB Ltd. reserves the right to change the prices indicated on the site without having to notify users of the updates made. The User is obliged to pay the price that was indicated on the Site at the time of placing an online order, regardless of whether the updated price is lower or higher. In the event of technical errors in the information published on the Site, resulting in the order not being fulfilled, rilus.bg shall have the right to refuse the execution of the order and shall not owe any compensation to the User other than the refund of the amounts paid by the User for the cancelled order, if any.
- ЗАЯВКА ЗА ПОКУПКА
Each purchase order from MIRAGE 96 - NB Ltd. through the e-shop is submitted and carried out in accordance with the General Terms and Conditions. In the event of a dispute as to whose will it is to be bound by the text of these General Terms and Conditions, the party to the contract shall be deemed to be the person who has paid the price of the goods requested for purchase.
5. Клиентът подава заявката, чрез попълване на електронна бланка публикувана на https://rilus.bg/. В заявката задължително следва да се посочи адрес за доставка, имейл и телефон за контакти.
6. В момента на извършване на заявката, Клиентът изразява съгласието си с настоящите Общи условия, чрез специално за това приложение, а именно: чрез отбелязване в полето „Съгласен съм с Общите условия” за покупко-продажба през електронния магазин” с което Клиентът извършва електронно изявление по смисъла на Закона за електронния документ и електронния подпис, с което декларира, че е запознат с настоящите Общи условия, приема ги и се задължава да ги спазва. Съгласие с настоящите Общи условия ще се счита и действието по отправяне на заявка /поръчка/ за покупка на стока от Клиента.
7. Със заявката за покупка, клиентът избира стоката и количеството.
8. Последният етап от поръчката е плащането. Плащането на цената се извършва
чрез превод по банков път /преди транспортиране на стоката/ . - Отказ от сключен договор и възстановяване на заплатената цена.
На основание чл. 50 от ЗЗП Купувач, който има качеството потребител по смисъла на ЗЗП в 14 /четиринадесет/ дневен срок от доставката има право без да дължи обезщетение или неустойка и без да посочва причина, да се откаже от сключения договор. In order to comply with the cancellation period, it is necessary and sufficient for you to send us your communication concerning the exercise of this right of cancellation before the expiry of the cancellation period. ТЕЛ: +359 32 900 777 - All transport and other costs for the return of the goods are entirely at the expense of the consumer (Buyer). Until the goods are handed back by the consumer to MIRAGE 96 - NB Ltd, the risk of accidental loss or damage shall be borne entirely by the consumer. In the event that the consumer exercises his right under Article 50 of the Consumer Protection Act, provided that he has fulfilled the above conditions, MIRAGE 96 - NB Ltd. shall be obliged to refund the price paid by bank transfer within 14 /fourteen/ days of the notification of withdrawal from the contract under Article 50.
11. Privacy. By accepting these General Terms and Conditions, the user gives his/her express and unconditional consent, until his/her possible explicit written revocation, for the personal data provided by him/her to be collected, stored, processed and used by MIRAGE 96 - NB Ltd. and/or third parties authorized by the company, including but not limited to: courier companies, banks, etc., for the purpose of the performance of the distance selling contract and delivery of ordered goods, and in the case of marketing and advertising purposes and analysis of MIRAGE 96 - NB Ltd, participation in games, promotions and raffles organized by the company, as well as for any other purposes not prohibited by law. The user may at any time obtain information on whether the personal data provided by him/her are processed and used by MIRAGE 96 - NB Ltd. The user is obliged to immediately inspect the goods and, in the event that he/she finds obvious defects, to immediately inform the person making the delivery. If he fails to do so, the goods shall be deemed to have been approved and the consumer shall lose the right to claim later that the goods were delivered to him with obvious defects. Claims for goods purchased through the online shop are made in accordance with the rules of the Consumer Protection Act and the terms and conditions of their commercial guarantee. VII. ДОСТАВКА
12.1. В случай, че заявената стока е налична, същата се доставя на посочения от Клиента адрес за доставка в срок до 7 /седем/ работни дни.
12.2. Срокът по горната точка започва да тече от момента, когато стоката бъде заплатена.
13. Доставката се извършва чрез услугите на куриер /спедиторско дружество/.
14. Задължението за доставка на стоката ще се счита за изпълнено с доставянето на стоката до сградата, в която се намира адреса на доставка, посочен в заявката.
15. Стоката се доставя подходящо опакована съобразно вида й и транспорта за доставка.
16. In case of an incomplete, incorrect or wrong address and/or telephone number when submitting an order, it shall be considered invalid and no obligation for its execution shall arise for MIRAGE 96 - NB Ltd.
17. In case the Customer does not make payment by bank transfer, no obligation for delivery of the ordered goods arises for MIRAGE 96 - NB Ltd.
VIII. ПРЕДАВАНЕ НА СТОКАТА
18. Стоката се предава на Клиента или на трето лице, което приема и потвърждава получаването на същата от името на Клиента като подписва придружаващите стоката документи.
19. In the event that the Customer is not found within the delivery period at the address indicated by him or is not provided access and conditions for delivery of the goods within this period and this leads to the impossibility of delivery of the shipment not due to the fault of the seller, MIRAGE 96 - NB Ltd. is released from its obligation to deliver the goods requested. In this case, the contract of sale is automatically terminated.
- ЦЕНА И НАЧИН НА ПЛАЩАНЕ
20. Всички цени на стоки в електронния магазин са в български лева, с включен ДДС и са обявени в електронния магазин. Цените са за единично количество и в цената не е включена стойността на транспортните разходи.
21.1. The cost of transport shall be paid by the Customer according to the established tariff of MIRAGE 96 - NB Ltd., which is announced on the website.
21.2. The agreed transport at the Buyer's expense shall be indicated in the bill, invoice and other documents under the following name: "24199 Delivery by courier".
21.3. Payments shall be made in Bulgarian lev only. - REVIEW OF GOODS. ADVERTISING
22. Complaints for goods purchased through the online store shall be made in accordance with the rules of the Consumer Protection Act. Address for complaints. Upon receipt of the goods, the Customer is obliged to inspect them immediately. If he/she finds obvious defects, he/she shall immediately inform the person making the delivery. In this case, an inspection report shall be drawn up in two identical copies, which shall be signed by the recipient of the goods and the representative of the courier /forwarding/ company. The report must describe the apparent defects.
23. In the event that the Customer does not make a claim at the time or even if he makes such a claim but does not sign a statement of defects, the Customer shall lose the right to later claim that the goods were delivered to him with obvious defects.
24. The customer, who is a consumer within the meaning of the Consumer Protection Act, has the right under Article 55, paragraph 1 of the Consumer Protection Act.
XIII. FINAL CLAUSES
25. MIRAGE 96 - NB Ltd. takes care that the information in the e-shop is always correct and up-to-date, as accurate information can be obtained by phone: 032 900 777
26. All sizes advertised in the e-shop are external. There may be discrepancies in the shades of colors from the photos on the e-shop website and the actual shades of colors of the products.
27. MIRAGE 96 - NB Ltd. does not warrant that access to the e-shop will be uninterrupted, timely, secure or error-free to the extent that it is beyond the ability, control and will of MIRAGE 96 - NB Ltd. .
28. MIRAGE 96 - NB Ltd. is a personal data administrator registered under the Personal Data Protection Act. MIRAGE 96 - NB Ltd. guarantees the privacy of the information containing personal data provided by the Customers. Disclosure is possible only in cases where the information is requested by state authorities or officials authorized by law to request and collect information containing personal data and in compliance with the statutory procedure. By accepting these General Terms and Conditions, the Customer gives his/her express and unconditional consent for the personal data provided by him/her to be collected, stored, processed and used by MIRAGE 96 - NB Ltd. for the purpose of performance of the contract for the purchase and delivery of ordered goods.
29. These Terms and Conditions are effective from the moment of their publication. MIRAGE 96 - NB Ltd. reserves the right to change these Terms and Conditions at any time by promptly publishing such changes on its website https://rilus.bg/, together with a notice of the changes.
The provisions of the current legislation of the Republic of Bulgaria shall apply to the matters not covered by these Terms and Conditions..
